In Topeka they cut the budget to the District Attorney's office by 10%. In retaliation to the cut, the DA made a power play by refusing to prosecute ALL misdemeanor offenses. (btw that includes possession of marijuana without the intent to sell, smoking marijuana, and growing less than five plants)

It just so happens that Domestic DISTURBANCES also fall into the misdemeanor category, and are also not being prosecuted. The Topeka DA tried to foist the prosecution of all the misdemeanors onto the City Attorney's office, but they said, "Fuck off, we're overloaded ourselves!" (Not a direct quote, in case you were wondering)

Domestic VIOLENCE cases however are frequently felonies. This is a judgement call made by the arresting officer and is usually based on if there are injuries or not. If I remember correctly, I think Topeka has a "Zero Tolerance" policy for Domestic Disputes. Namely if there is a Domestic situation and the cops are called, if either party in the disturbance placed their hands upon someone else, that person is charged with a misdemeanor and they spend the night in jail. No exceptions. This policy is NOT a judgement call of the arresting officer, and there are severe reprimands for officers that ignore the "zero tolerance".

AT NO TIME DID POLICE OFFICERS STOP ARRESTING PERPETRATORS OF DOMESTIC VIOLENCE.

Now I'm of the personal opinion that any man that touches a woman in anger should have the living shit beat out him. I have also stood behind those words with actions that support that position.

However, in looking at the Topeka case, this is a pissing match between the DA's office, the City Attorney's office, and the City Council. It has little to do with prosecuting wife beaters, it has nothing to do with the Tea Party or Republicans, and it's flat out bullshit to say they aren't ARRESTING people for wife beating.

But you should be happy. If you get busted on a bong in Topeka, you won't be prosecuted for that either.

Since the county stopped prosecuting the crimes on September 8th, it has turned back 30 domestic violence cases. Sixteen people have been arrested for misdemeanor domestic battery and then released from the county jail after charges weren’t filed. “Letting abusive partners out of jail with no consequences puts victims in incredibly dangerous positions,” said Becky Dickinson of the YWCA. “The abuser will often become more violent in an attempt to regain control.” The YMCA also said that some survivors associated with their Center for Safety and Empowerment were afraid for their safety if the dispute wasn’t resolved soon.

Of course, if you’d somehow gotten the impression that domestic violence is not really all that much of a priority for the county (which stopped prosecuting the cases almost a month ago) or the city (which is seriously considering officially legalizing the crime), think again. On the contrary, everyone involved professes to believe, as the DA’s office said, “that domestic violence is a crime that should be taken seriously and charged.” It’s just that everyone wants someone else to pay for it. And honestly, as deep cuts to state and local governments across the country take their toil, it’s hard to blame them too harshly for that. Thanks, austerity!

FYI .. people from Pokah will remember when I was in Moab I worked as a volunteer in a womans shelter. We had a sick fuck named StinkFinger who would accuse me of molesting young women. Stink hated women. He even went so far as to call the shelter and tell them about the Pokah Forum.

OK a genuine enquiry. In UK that would mean the the abused person had withdrawn charges and refused to press charges.
