I would consider it a privacy issue if this were a video taken in a changing room perhaps, or if private areas of her body had been exposed. Obviously it is a "consent" issue, but does that apply when you are in an establishment you know to be wired up with cameras? I'm certain they have policy and procedures in place regarding their security video footage, so perhaps disciplinary actions against the security department manager for P&P breaches, even if he didn't release it. Let the shit roll down from him to the rest of the staff who had access to it. I suppose an apology would be in order, but she should have to post a public service announcement on youtube addressing the silliness and hazzards of texting & walking.

Actually the Utube thing isn't grounds for a law-suit as when you enter the mall you know (informed consent) you are being taped and therefore open to public disclosure.

The gaff was that the security guards may have violated mall rules of disclosure and may be terminated. Had that been a results of someone like me taking a video of her and not disclosing to her that my intention was to submit it to some media outlet for profit ... there she may have a case.

However the mall discloses that you may be on surveillance camera conduct yourself accordingly because you know the video is their property and you gave your consent once you entered their private property and are subject to their rules.

Her best bet of winning a cash settlement would be suing because there is a man made flaw in their safety around the pond and had there been a barracade or structure around it to prevent people (along with young children) from inadvertently wandering in it.

It may be too late to claim injury as she reportedly went after invasion of privacy which doesn't exist on private property in most cases say unless they were to vidio her in and or on a toilet.

That's the issue with the use of x rays at airports and so far all courts have upheld the right of Home Land Security to tape your private areas even after cases in where they have been shown to the public.
