    The reason that big businesses don't want to see it passed as is is because they could potentially end up in a contract with stipulations set by a 4th party, which would be the Arbitrators (keep in mind most of these arbitrators are prior union delgates or organizers). Now, truthfully speaking, a company like Wal-Mart doesn't want to see it because they do underpay and manipulate benefits, etc.

    The posting with the explanation of the bill came from a law firm that did a seminar on the topic recently (January 2009).

    Also, keep in mind the idea of this bill (HR 800, the original version) has been around long before Obama was ever considered for the presidency. So I'd have to argue about anti-Obama people being against it just because he supports it.

    If the Board finds that a majority of the employees in a unit appropriate for bargaining has signed valid authorizations designating the individual or labor organization specified in the petition as their bargaining representative and that no other individual or labor organization is currently certified or recognized as the exclusive representative of any of the employees in the unit, the Board shall not direct an election but shall certify the individual or labor organization as the representative described in subsection (a).

    Like I said, there's nothing to be afraid of(unless you're "management").

    This bill does nothing but HELP the "average person". It's set up so the company would have to take action in a reasonable amount of time and not try and drag it out for years. If they don't, that's why it would go to arbitration.

    It comes down once again to "The big guy" vs "The little guy". And this bill is set up to help and protect the rights of the little guy. And it's got Repubs pissed because they're only interested in helping the rich and big business.

    IMO this all goes back to what we've all talked about in other threads...The bottom line problem in politics, business, and LIFE...greed and character! Big business (in some cases)manipulates employyees with low wages and ever changing benefits...then the unions over compensate (in some cases) with very taxing demands and unaffordable compensation. Where is the ROOT of the dilemma? WE the people...human greed (on both parties side) and less than stellar character (corruption, on both sides). If big business could suddenly become compassionate to the needs of employees...and workers understand the "plight" of business and trying to stay afloat in this economy...then, maybe, it would get better...hold your breath, o.k.?

    After I weigh all the above pros and cons, I can't help believe that without the flawed ideal of unionism...the people get snookered!!

    The so called big boys are fookin' ruffians to the core. 'Hoodwink the small guy' is their motto!

    I think all of the above comments are great. The one HUGE concern I would still have with this becoming law is this:

    Taking away a secret ballot election (which is how this country votes on things!!!) to me can only be viewed as big labor being scared of secret ballot elections, right? I completely agree with the idea that businesses shouldn't be allowed to drag out contract negotiations, but there should always be a vote IMO!

    This bill doesn't take away the "secret ballot", it just gives the employees the "CHOICE" whether or not to use it.
