Disabled mother could be sterilised without her consent
A woman with a learning disability could be forcibly sterilised after she gives birth this week to stop her becoming pregnant again.

The secretive Court of Protection will rule on the woman’s treatment on Tuesday, in a rare open hearing scheduled because of the overwhelming “public interest” in understanding the case.

She is due to give birth by caesarean section the following day and could undergo an operation to sterilise her at the same time if the court agrees.

Disability campaigners described the prospect of such a “drastic” step as “quite wrong”.

The woman will be represented by the official solicitor, a government lawyer who acts for those who cannot instruct their own legal team because they lack capacity.

The patient’s NHS trust and council have made an application to the Court of Protection to decide whether she is incapable of making decisions about contraception herself and if so, whether she should be sterilised by means of “tubal ligation

”.

In my opinion if they sterilize her they are going about contraception drastically. Why not pass judgement on her having an implant... at least that can be temporary. In my opinion if they sterilize her they are going about contraception drastically. Why not pass judgement on her having an implant... at least that can be temporary. I don't agree with the NHS being able to through the Mental Capacity Act. I found the following:

The act's purpose is:

* To allow adults to make as many decisions as they can for themselves.
* To enable adults to make advance decisions about whether they would like future medical treatment.
* To allow adults to appoint, in advance of losing mental capacity, another person to make decisions about personal welfare or property on their behalf at a future date.
* To allow decisions concerning personal welfare or property and affairs to be made in the best interests of adults when they have not made any future plans and cannot make a decision at the time.
* To ensure an NHS body or local authority will appoint an independent mental capacity advocate to support someone who cannot make a decision about serious medical treatment, or about hospital, care home or residential accommodation, when there are no family or friends to be consulted.
* To provide protection against legal liability for carers who have honestly and reasonably sought to act in the person’s best interests.
* To provide clarity and safeguards around research in relation to those who lack capacity.

Under the Mental Capacity Act a person is presumed to make their own decisions “unless all practical steps to help him (or her) to make a decision have been taken without success”.

The onus will be on the NHS to prove they have explored all other avenues and in reading the article, it doesn't sound like they have.

Biggest block the Court will face is the Human Rights Act which will override the Mental Capacity Act as it is is set by the European Convention and not UK law.

I know what the MCA is all about I was lucky to have mandatory training on it last week. I was stating the NHS had to follow those laws. If they follow those laws they cannot surely make the decision to sterilise the woman (court inc). Being that people and circumstances are fluid, ie constantly changing, they cannot (IMO based on the Act) make a permanent decision such as this. The decision should be one that can be changeable.
